Time-Line Notes Note 1: Last day to send notification to neighbors This is the last day for which the applicant must have sent notification to the neighboring properties (adjacent landowners). A sample letter follows these notes. It must include a filled out copy of the County's application. See below. Notification must be sent by U.S. Mail with proof that the letter was sent. The applicant must have proof of mailing at the Planning Commission Hearing. Proof may be in the form of a Post Office receipt. In the event that a neighboring property owner cannot attend the Planning Commission Hearing and/or the subsequent Board Meeting, the neighboring property owner may submit written comments to the Planning Commission Chairperson for public reading at the Planning Commission Hearing and the Board Meeting. Written comments from other than adjacent landowners will not be accepted. Remedy for failure to provide proof of mailing: Unless all neighboring property owners are present and by their unanimous decision waive their right to four weeks notice, this case is to be tabled until such proof is provided. Remedy for discovery that incomplete or inaccurate information was mailed: Unless all neighboring property owners are present and by their unanimous decision waive their right to four weeks notice, this case is to be tabled until such proof is provided. General Remedy: The Planning Commission at the time of the hearing may resolve any issues not specifically addressed or remedied within this document. Note: It is possible that the applicant may accept alternative recommendations from Planning Commission. Adopting Planning Commission recommendations and/or conditions does not require subsequent notification to the neighboring property owners. Note 2: Publish on Web Site This is the recommended last day for which Webmaster should post the request on the web site as an agenda item at the next planning commission hearing. Failure to meet this date is not the fault of the applicant and does not interrupt the process. Note 3: Send Legal Notice to the Peotone Vadette This is the last day for which the Peotone Vadette should be notified to publish the legal notice for this application. See note 5 for remedies. Note 4: Last Day to Post Sign On Property Signs are available to the applicant from the Township. The applicant should notify the Planning Commission Chairperson when the sign is posted so that proof can be obtained. If any township official witnessed the sign, but the sign became vandalized or blown away, then any township official should be notified to have the sign replaced by the Township. If it is determined that the sign was stolen or vandalized, then a police report should be filed and the police should be asked to keep an eye on its replacement. Remedy for failure to post: Admitted failure to comply is cause for this case to be tabled at the Planning Commission Hearing. It may be rescheduled for the following month with the applicants agreement to comply. Remedy for refusal to comply: Blatant failure to comply shall cause the Planning Commission to vote to deny the request. The Board also vote to deny the request. Both the Commission and the Board should each send letters of denial to the County. The letters should indicate the reason for the denial. Remedy for failure to post on time: The Planning Commission may resolve this issue at the hearing. Note 5: Publication of Legal Notice in the Peotone Vadette This is the last day for which the Peotone Vadette should have published a legal notice for this application. The Vadette is typically received weekly on Wednesday or Thursday giving the public 11 to 12 days notice. Remedy for failure to publish in time: The applicant must be notified and the hearing must be postponed to the following month. Note 6: Soil and Water Conservation Data Obtaining Soil and Water Conservation Data is the responsibility of the Plan Commission. Failure to comply with this item shall not be cause for postponing or tabling the hearing. Enclosed is a copy of the Will County Land Use Departments Application for Zoning Request form to be used by the Green Garden Township Plan Commission. You may view the anticipated timeline for this request by going to http://www.greengardentownship.org/process.htm [The applicant must provide a filled out application from the Will County Land Use Department.
